ATO debt timeline: how long can I wait?

Why a timeline matters
Tax debt feels shapeless: a balance that grows a little each day. But underneath it are a handful of hard dates set by law or triggered by notices. Knowing them turns a vague worry into a plan. This tool uses the rules the ATO and AFSA publish:
- Lockdown at three months. GST or PAYG withholding reported more than three months after the due date can only have its director penalty remitted by payment. Lodging on time — even without paying — avoids this.
- Credit reporting. ABN holders with $100,000 or more overdue for more than 90 days, who aren't effectively engaging with the ATO, can be disclosed to credit bureaus after a 28-day warning letter.
- Director penalty notices. 21 days from the day the ATO posts the notice to your ASIC-registered address.
- Statutory demands. 21 days to pay the whole debt or enter a payment plan with the ATO.
- SG charge under Payday Super. Payable on the day it's assessed; a notice to pay follows if it's unpaid after 28 days, and late payment penalties can apply if it's still unpaid 28 days after that.
What the timeline doesn't show
Reminders, warning letters, collection-agency referrals and garnishee notices don't follow fixed dates — the ATO decides when to use them based on the amount, your history and whether you're engaging. If a milestone is close, act on it first: lodge to stay out of lockdown, engage before the 28-day credit-reporting window closes, and treat any 21-day notice as urgent. How long can I wait before the ATO takes action?
There's no guaranteed period. The ATO can take firmer action at any time after a debt is due. This timeline shows the milestones that come from the law and from notices — not a schedule the ATO must follow.
When does a director penalty lockdown apply?
When GST or PAYG withholding is reported more than three months after its due date, or isn't reported, the director penalty for that amount can only be remitted by paying it in full.
When can the ATO report my business debt to credit bureaus?
When an ABN holder has $100,000 or more overdue by more than 90 days and isn't effectively engaging with the ATO. The ATO writes first, giving 28 days to act.
What happens if an SG charge assessment isn't paid?
