How to verify anyone in two minutes

  1. Registered liquidators and restructuring practitioners — search ASIC's professional registers.
  2. Registered bankruptcy trustees — check with AFSA.
  3. Tax agents — search the Tax Practitioners Board public register. Anyone negotiating with the ATO for a fee must be registered.
  4. Lawyers — check the law society or legal practice board in your state.
  5. Professional bodies — ARITA, CPA Australia and CA ANZ list members.

Why these warnings exist

ASIC says the pre-insolvency industry is unregulated and advisers have varying qualifications and experience. The ATO warns that following bad advice — especially advice to move assets or mislead authorities — could put you at risk of a fine, criminal conviction or even a jail term. ASIC notes penalties for illegal phoenix activity of up to 15 years' imprisonment for directors, and the same can apply to those who encourage it.

None of this means insolvency professionals are untrustworthy. Registered liquidators and trustees are regulated and accountable, and many do excellent work. Does one red flag mean an adviser is dishonest?

Not necessarily. One flag is a reason to check registration, ask questions and get things in writing. Several flags together are a strong reason to stop and get a second opinion.
